The SEWP VI contracts comprise a multi-award Government-Wide Acquisition Contract (GWAC). SEWP VI contracts streamline the process of providing federal agencies with state-of-the-art tablets, desktops and servers; IT peripherals; network equipment; storage systems; security tools; software products; cloud-based services; video conferencing systems, and other IT and audio-visual products; as well as related services such as installation, training and maintenance. All federal agencies and their contractors can place orders through this GWAC. NASA’s Goddard Space Flight Center in Greenbelt, Maryland, procures and manages the SEWP VI effort.

Fair Opportunity and Requests for Quotes

Contractors will be provided a fair opportunity at the individual order level as appropriate per FAR Part 16.505(b), including the SEWP RFQ tools. No documentation for the order selection is required to be submitted with the order. All such documentation is to be maintained by the issuing procurement office.

The Contractor shall not market, quote or otherwise offer for sale, any IT Solutions not listed under this contract, until the said solutions are included in the SEWP database of record, and available to all Government end-users.

If the Government issues a Request For Information (RFI) as part of market research, the Contractor may provide items not yet listed on their SEWP contract as part of a market research quote if:

  • all such items are clearly marked as not yet available on their SEWP contract

  • the contractor submits a technology refreshment request to add those products to their contract

If the Government issues a Request For Quote (RFQ) or a Market Research Request (MRR), the Contractor may only respond with items available on their Contract and the price of each item shall be no greater than the price in Attachment F SEWP database of record at the time the quote is issued. If the Contractor has insufficient items on their contract to fully respond to the Formal RFQ, the Contractor must respond with a No Bid.

Unless the RFQ specifically allows for partial quotes, the Contractor must respond fully to all requirements specified in the RFQ.

When submitting a quote to a government end-user, the contractor must clearly state the length of time the quote is valid. The contractor shall honor any order submitted within the stated time period of a quote.

When responding to an RFI or RFQ issued from the NASA SEWP RFQ on-line quoting system, the Contractor must respond as outlined in Attachment C: Contract Holder User Manual (CHUM).

Contract Holders are prohibited from using Government information posted on the NASA SEWP Contract Holder Only Page, such as RFQs, RFIs, etc., for purposes other than proposing on SEWP requirements. This includes Contract Holders providing third parties with SEWP information and requirements for the purpose of assisting companies, that are not SEWP Contract Holders, with providing unsolicited proposals to meet agency requirements already posted to the NASA SEWP RFQ on-line quoting system.

  • Market Research: According to Federal Acquisition Regulations, (FAR) Part 10, appropriate market research based on the size and complexity of the acquisition is required. The Online Market Research Tool and Quote Request Tool SEWP tools assist in this market research process.

  • Fair Opportunity: FAR 16.505(b) (1) provides that each contractor shall be given fair opportunity to be considered for each order exceeding $10,000 and issued under multiple award contracts. The FAR states that the method to obtain fair opportunity is at the discretion of the CO and that the CO must document the rationale for placement and price of each order. Using the SEWP online Quote Request Tool is the recommended method to assist in this activity and to augment the required decision documentation. The SEWP QRT tool will automatically include the Contract Holders within a selected Group or based on a suggested source. NOTE: Fair Opportunity to all Contract Holders within one or more SEWP Groups or set-asides is required. There is no requirement to obtain 3 quotes as long as all Contract Holders within a Group or set-aside were provided opportunity to provide a quote.

  • Best Value: Once market research is completed, the end-user’s needs, technical requirements, Contract Holder program performance, price, Agency policy and other factors related to the exercise of sound business judgment should be considered in making a best value determination.

Warranty and Technical Support

Hyperion, Inc. is committed to providing responsive warranty, technical support, and post-delivery assistance for products and services ordered under its NASA SEWP VI contracts. Warranty coverage applicable to an individual order will be based on the products, services, manufacturer warranty terms, and specific requirements incorporated into the applicable Delivery Order.

Product Warranty

Products furnished by Hyperion, Inc. will be supported in accordance with the applicable manufacturer’s warranty. Manufacturer warranty terms vary by product and manufacturer. Applicable manufacturer warranty information will be provided as appropriate for the products included in an order.

Hyperion distinguishes the manufacturer’s product warranty from its own workmanship coverage. After a manufacturer’s warranty expires, Hyperion may attempt repair, with repair, replacement, installation, and travel potentially handled on a Time and Materials basis under the terms applicable to that installation.

Customers requiring extended warranty coverage should identify the desired coverage period and support requirements when requesting a quote so that Hyperion can identify applicable extended-warranty options and incorporate them into the proposed solution.

Installation and Workmanship

For orders involving installation services, Hyperion, Inc. warrants its workmanship in accordance with the requirements and terms of the applicable Delivery Order and warranty documentation. Hyperion’s Limited Workmanship and Product Warranty defines “Workmanship” as the manner and standard to which the installation and related work are performed according to the contract documents.

Warranty periods, included corrective services, on-site support, travel, and any subsequent Time and Materials support will be identified as applicable to the specific order.

Technical and Post-Delivery Support

Hyperion, Inc. provides customers with a point of contact for order issues and post-delivery support, including installation, basic and extended warranties, and technical and software support.

For warranty or technical support inquiries, customers should provide the applicable order or contract information, the affected product or installation, and a description of the issue.

For formal claims under Hyperion’s Limited Workmanship and Product Warranty, send written notification by email that includes a detailed description of the problem, the installation name and address, and contact information for both the entity that originally contracted with Hyperion and the current owner of the installation.

Software Support

Software warranty, maintenance, licensing, updates, and technical support will be provided in accordance with the applicable software publisher’s terms and the requirements incorporated into the applicable Delivery Order. Where available and requested, Hyperion may include applicable software maintenance or support options as part of the quoted solution.

Warranty Claims and Resolution

Where Hyperion’s Limited Workmanship and Product Warranty applies, Hyperion must be notified in writing within ten (10) days after discovery of the condition giving rise to the claim and must be given the first opportunity to access the site and inspect the alleged defect before corrective action is taken by the purchaser or a third party. If the condition is determined to be covered, Hyperion will be given the opportunity to cure the defect within a reasonable period.

Under that warranty, the purchaser’s remedy is limited to repair and/or replacement at Hyperion’s discretion in accordance with the applicable warranty coverage.
